Regulation on the Export and Import of Certain Hazardous Chemicals Consulting Service

Regulation on the Export and Import of Certain Hazardous Chemicals; Prepared by the Republic of Turkiye Ministry of Environment, Urbanisation and Climate Change in accordance with the European Union PIC Regulation (Prior Informed Consent Regulation), published in the Official Gazette No. 32087 on January 28, 2023, and entered into force on July 28, 2023.

The Regulation is implemented to ensure compliance with the requirements of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, to protect human health and the environment during the international movement of certain hazardous chemicals and pesticides, to ensure the environmentally sound use of hazardous chemicals, and to facilitate the sharing of information on the specified substances.

The Regulation covers chemicals that are prohibited or severely restricted by the Ministry and relevant institutions, chemicals listed in Annex 1 of the Regulation, which are subject to the Prior Informed Consent (PIC) procedure, and chemicals listed in Annex 2 of the Regulation, while excluding certain uses such as radioactive substances and mixtures, waste, food and food additives, animal feed, medical products for human or veterinary use, etc. Chemicals listed in Annex 6 of the Regulation cannot be exported.

Within the framework of compliance with European Union legislation, the European Parliament and Council Regulation (EU) No. 649/2012 (PIC Regulation) dated 27/7/2012, which is used as a reference, must be carefully followed. Recently, 40 new chemical substances have been added to Annex 1 of the PIC Regulation.

Safety data sheets must be prepared up to date for exports, products must be packaged and labeled in accordance with current legislation, and the Ministry must be informed prior to export and under specified conditions. These notifications must be made via the e-ÖBK system (Integrated Environmental Information System).
