ECHA Finds One in Three Biocidal Products to be Non-Compliant!!!

ECHA conducted an enforcement project across the European Union, which identified approximately 60 active substances in biocidal products that are not authorized in the European Union, European Economic Area (EEA), and Swiss markets. One-third of the products checked were found to be non-compliant with at least one legal requirement.

In this context, more than 3,500 biocidal products were checked in 29 countries, and 37% of the biocides checked were found to be non-compliant with at least one of the legal requirements checked.

  • It was determined that 18% of the products inspected did not have a product license or contained unauthorized active substances; they did not comply with the basic requirements affecting their safe use, and 60 unauthorized active substances were found in these products. Most of the biocides with such significant non-compliance were disinfectants, insecticides, and insect repellents/attractants. All products without a license or containing unauthorized active ingredients were withdrawn from the market. In some cases, criminal complaints were filed or fines were imposed.
  • The remaining 19% of non-compliant products were found to have minor deficiencies that did not affect safe use, such as missing supplier contact information. In these cases, national authorities issued recommendations or, in some cases, administrative decisions.
  • Numerous non-compliances were also found in disinfectants sold to consumers. Of the approximately 1,900 disinfectants inspected, 265 (14%) were found to be non-compliant. This was generally due to serious compliance issues, such as lack of authorization or incorrect labeling, which usually led to the withdrawal of the disinfectants from the market.
